Namaste! shop.khamir.org is an eCommerce site that extends from Khamir as a digital platform to promote and facilitate the online selling of traditional, artisanal crafts from Kutch. The platform is owned and operated by Khamir Craft Society, Kutch, India hereafter referred to as Khamir or Khamir Platform. 

 

Before diving into our Terms of Use, we’d like to thank you for dropping by and helping us in our commitment to handmade. By choosing handmade over machine-made, you are not only helping create sustainable livelihood opportunities for our community of artisans and craftspeople but also helping preserve and revive some of Kutch’s traditional crafts. 

 

We’d like you to know that while visiting or shopping at www.shop.khamir.org and its affiliates, you are subject to certain conditions. It’s therefore important for you to read them carefully. Besides, when you use any current or future www.shop.khamir.org service/s or visit or purchase from any businesses affiliated with khamir.org, whether or not included on the www.shop.khamir.org site, you will be subject to these guidelines and conditions. 

 

The following Terms of Use for the shop.khamir.org is a legally binding agreement between Khamir entity, You ("You”, “Your” or collectively "Users") comprising users registered on the Khamir platform. If you provide any information that is untrue, inaccurate, not current or incomplete or Khamir has reasonable grounds to deduce that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this User Agreement, Khamir reserves the right to indefinitely suspend or terminate or block your use or access to the Website in any manner whatsoever.

Except for any User Content that is provided and owned by Users, all Materials contained on the Khamir Platform are the property of Khamir or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to Khamir or its affiliates and/or third-party licensors. Except as expressly authorized by Khamir, You agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Materials. Khamir reserves all rights not expressly granted in this Terms of Use. Any violation of our trademarks will be liable for legal action.

Risk of Loss
All items purchased from shop.khamir.org are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Pricing
Except where noted otherwise, the Product Price displayed for products on our website, whether in foreign currency or Indian rupees, represents the full price of the product inclusive of taxes but exclusive of shipping charges, unless specified otherwise in the shipping fees.

With respect to items sold on khamir.org we charge you before your order has entered the shipping process. For any reason, if we are not able to ship your products as per your order, we will intimate you electronically and refund the value of the products not available. In case of any additional shipping fees, if applicable, will not be refunded.

Despite our best efforts, a small number of the items in our catalog may be mispriced. If we discover a mispricing, we will do one of the following:
a. If an item's correct price is lower than our stated price, we will charge the lower amount and ship you the item
b. If an item's correct price is higher than our stated price, we will at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
Please note that this policy applies only to products sold and shipped by www.shop.khamir.org.

The prices displayed on this site are quoted in Indian Rupees (Re) which you can view in your preferred currency using the currency converter link. This currency converter is only indicative and a value-added tool. The actual amount to be paid by you will be the equivalent amount in the currency of your debit/credit card, as per the conversions done by your bank/credit card provider on the date of billing.

 

Duties and Taxes
All our “international orders” will be shipped from our warehouse in Bhuj, Gujarat, India to your provided shipping address via FEDeX. Due to the nature of international shipping, a customer may have to pay additional import duties and taxes which are levied once a shipment reaches your country. However, we are unable to calculate when and how much these infrequent customs duty charges will be levied. In the case where additional customs charges are assessed, you will be responsible for paying these additional fees. To make your shopping experience as seamless as possible, we have arranged with FedEx to customs clear your goods for you and deliver them to your doorstep. If you are presented with an invoice from FedEx for import duties and taxes, you will have to pay FedEx directly at the time of delivery. KHAMIR takes no responsibility for the non-delivery of orders in case such taxes and duties are not accepted and settled by the recipient at the delivery address and will not provide any refunds in such cases.

Product Properties
All of Khamir’s products are handcrafted by communities of artists, artisans, craftspeople, and designers. The subtle variations in colour, texture, and finish are intrinsic to handmade products. Our products involve crafts-based traditions of hand spinning, dying, weaving, woodblock printing, felting, carving, and embroidery. We use vegetable dyes with the goal of minimizing our impact on the environment while striving for the best colour properties. We’d like for you to not treat an irregular weave or print as a defect - handloom by definition means uncertainty when it comes to uniformity.

Disclaimer of Warranties and Limitation of Liability
Our eCommerce website, www.shop.khamir.org, is provided by Khamir on an "as is" and "as available" basis. Khamir makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, Khamir disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We, therefore, reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfill any order that you might’ve placed based on such erroneous, inaccurate, or out-of-date information regarding pricing, shipping, payment terms, or any of our policies.

To the maximum extent permitted by applicable law, khamir.org assumes no liability or responsibility for:
a. Any errors, mistakes, or inaccuracies of the content displayed on the website
b. Any personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our website or any purchased product
c. Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein
d. Any interruption or cessation of transmission to or from the website
e. Any bugs or viruses that may be transmitted to or through our website by any third party

Indemnification
You agree to defend, indemnify and hold khamir.org and its affiliates harmless from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the site.

Applicable Law
By visiting shop.khamir.org, you agree that the laws of India, under the jurisdiction of the Delhi High Court, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and khamir.org and/or its affiliates.

Disputes
Any dispute relating in any way to your visit to khamir.org or to products you purchase through khamir.org shall be submitted to confidential arbitration in Bhuj, Gujarat, India.
